Show this act, the commission may bring any legal action necessary in behalf of the employee to collect such claim for unpaid wages. The commission shall not be requix'ed to pay the f111.ng fee, or other costs, in connection with such action. The commission shall have power to join various claims against the employer in one oause of action. (5) In proceedings under thj.s section, the district court other affirmative action as appropriate, including order may reinstatement of employees disoharged Ln violation of this act. (6) The commission shall have power to petition any court competent Jurisdiction to restrain violations or section 2, and for such affirmative relief as the court may deem appropriate, including restoration of unpaid wages and reinstatement of employ ees, consistent with the purpose of this acta of Section 5. Court aotion under this act ny be commenced later than two years after the cause of action occurs. no Section 6. Every employer subject to this act shall make, keep, and maintain such reoords of the wages and wage rates, job classifications" and other terms and conditions of employment of the persons employed 'by hlm, and shall preserve such records for such periods of time, and shall make such reports therefrom as the commission shall prescribe. Section 7. Every person subject to this act shall keep an abstract or copy of this act posted in a conspicuous place in or about the premises wherein any employee is employed. Employera shall be furnished copies or abstracts of this act by the state on request without charge. Section 8. (1) Any person who violates any provision of this act, or who discharges or in any other manner discriminates against any employee because such employee has made any complaint to his employer, the commission, or any other person, or has 1nst1tu·ted, or caused to be instituted any proceeding under or related to this aet, or has testified or 1s about to testify in any such proceedings, 1s guilty of a misdemeanor. (2) Any employer who violates this act by failing to keep required hereunder or to furn:tsh such records to the commission upon request, or who falsifies such records, or who hinders, delays or otherwise interferes with the commission or its authorized representat1 ve in the performance of h:t.s duties in the the records enforcement of this aot, or refuses such official entry into any place of employment which he is authorized by this act to inspect, shall upon conviction be subject to a fine of not more than $500. Section 9. It any provision of this act or the application ot such provision to any person or circumstance 1s held invalid, the validity of the remainder of the act and the applicability of such proVision to other persons or circumstances shall not be affected thereby. 3 |
