Well , I have been considering this question since it was informally discussed at the close of ( yesterday's yesterdays ) session , and I am clear that the fact that various parties may have located claims on these rivers has no relevancy to the question of the ( owner owner- owner ) ship of the bed of the river , except to this extent , and I think that the evidence is ( admis- admis ) sable under very narrow limitations , as the question of navigability depends not only on the physical use of the river , but on its potential or actual use for commerce in a useful way . ( R . 4283 . ) CHRIS HALVERSON For Complainant ( Record , Vol . 25 , pp . 4285-4291 ) He has resided in the vicinity of Greenriver Utah , , for about forty years , and by occupation is a farmer and stock raiser . ( R . 4285 . ) He helped operate the ferry at Greenriver during the high stage of water off and on for three or four years , starting in the summer of 1889 or 1890 . ( Out- Out ) side of this , he has never operated any boats on the Green River . ( R . 4285-4286 . ) During the time that he was in and about ( Green- Green ) river and at the ferry he does not know any case where any of the merchants or other business men in Greenriver received any merchandise by way of the river . He was not taking any interest in the river traffic that was going on there ; lie had other business . ( 33307-31-VOL 3330731VOL ) . . 2-23
