Show 45o LE JOURN AL Ceft fur ces preuves qui avaient été fes,& qui font très-certaines, qu'on ^eftcru obligé de meure ces Etabliflemens dans la compilation, comme une Ordonnance, quoy qu'ils Te trouvent dans differens manukrits fous le titred'Ufage^ deTouraine & d'Anjou. Il y a plufieurs Ordonnances qui regardent les Droits du Roy > comme la Regale , les Aubaines, & les Batardifes, les francs Fieft, Se nouveaux Acquefts : par exemple, le Te* flament de Philippe Augufte touchant la Re-gale, eft une très-belle Pièce ; à quoy il faut joindre les Ordonnances M. S. du a, Septembre 1332. & 8. Odobre 1334. On fera bien aife d'apprendre que nos Rois faifbient quelquefois des Ordonnances par leur- Teftamens : tel eft celuy de Philippe Augufte fait à Paris en 1190. fur lequel on a fait une noce , pour avertir qu'il ne le faut pas confondre avec fbn Teftament tb 1222. & dans laquelle oti obferve que Joly & M* du Cange , en citant des articles de cette Ordonnance de 1190. n'ont pas (çu qu'elle étoic iaite en forme de Teftament, non plus que Chopin en fon Traité de j&cra Poliii* 3 comme on Ta remarqué fur l'Ordonnance qu'il date de 1220. & qui eft apparemment un article de celle de 1190. Saint Louis dans une Ordonnance touchant les ufures, qui eu de 1256. ou 1257. a dit qu'U vouloit qu'elle fût exécutée, même en «s de mon, conune fon |
