Dear Paul and Karen: In accordance with Section VIII, Paragraphs 55 through 59, of the Administrative Order (Order) referenced above, for the NFS/WWTP Site, I am enclosing a copy of a check from Kennecott Utah Copper Corporation (Kennecott) made payable to the "EPA-Hazardous Substance Superfund" in the amount of $76,738.42. The check is enclosed with the accompanying transmittal letter which was sent by certified mail to Mellon Bank today. on Consent By making this payment today, Kennecott in no way waives any rights or challenges it may have with respect to the cost documentation nor does it waive any rights or challenges it may have with respect to whether the costs claimed by EP A are consistent with CERCLA and the NCP and properly recoverable by EPA. Payment is being made at this time so that it will be paid within the 60-day time frame specified in Paragraph 51 of the Order. Kennecott assumes that the reservation of rights, included in EPA's March 31, 1998 billing letter is merely part of a generic form used by EPA. Reservation of rights relating to response costs incurred by EPA for the NFS/WWTP Site is specifically addressed by the Order and not by EPA's transmittal letter. |
