Lufage des Fiefs a pareille-! ment introduit le Droit féodal en Allemagne ; mais le Droit civil & canonique n'y ont d'autorité qu'autant qu'ils font conformes aux préjugez & aux mœurs du Pays. VI. Des Loix générales, l'Auteur paffe a celles qui font particulières à chaque Province de l'Empire d'Allemagne. Il fait voir que les Etats de l'Empire n'ont pas moins de pouvoir de faire des Loix pour les Terres de leur détroit, que pour l'Empire uni-verfel ; & que ces Droits dérivent l'un & l'autre de la même fource. Cette fuperio-rité territoriale eft néanmoins plus étendue dans les uns, & plus refïèrrée dans les autres. Les Saxons 3 à qui l'Empereur Char-lemagne avoit laiffe une plus grande liberté, ont été extrêmement jaloux de fe la con-ferver ; c'eft pourquoi encore aujourd'hui les Ducs de Saxe, comme Proteâeurs du Droit particulier de leur Province , ne manquent point d'intervenir à la publication des Loix générales, & de faire leurs proteftations qu'elles ne peuvent nuire ni prejudicier aux droits &libertez de la Saxe.
