THE SPECIAL MASTER: That is as I understood his testimony. BY MR. FARNSWORTH: Q When were you last there? A I was at Warm creek last in 1916. Q How do you know the coal was still there? A I could see the sand piled up over it; I knew where it was. Q You knew where it had been left. Did you see any of the coal? A I don't know as I seen the coal, no. Q How do you know the coal was there, that wasn't taken off? A I know it is there. Q All you saw when you back was that there had been drifting sand in that locality? A Sand drifted right up where the coal was. Q Where the coal had been, is what you mean. A Where it had been, yes. Q Whether it was a solid sand pile -- MR. BLACKMAR: He means where the coal was. MR.
