Show 1525 14 Bellenbaugh- D 3503 appearance disclosed the fact he had no knowledge of the river. THE SPECIAL MASTER: Mr. Dellenbaugh has testified he knew he did not have any knowledge, and I think that is sufficient. How he looked -- he may have been a particularly timorous man. I don't know as to that, I don't think that is competent -- that is, I think it is competent, but I don't think it is particularly relevant. BY MR. BLACKMAR: Q Mr. Dellenbaugh, do you recall the river between Gunnison Crossing and the mouth of the San Rafael? A Yes, I do. Q Will you please just describe it as you saw it there in 1871? A Well, there are no rapids in there in that region, just swift water with riffles, that is, might be called rapids elsewhere; they didn't amount to much in that stretch. Q When you say they didn't amount to much, are you comparing them with the rapids which you got up above? A Oh, yes. MR. FARNSWORTH: Don't answer so quickly. I have a right to object here. Please don't volunteer your answers so quickly. MR. FARNSWORTH: We object to it, your Honor, as leading and suggestive. This counsel has not been on the river. The witness evidently has. I am going to object to his leading this witness. I don't think he ought to lead him. |
