A It is almost impossible to go up the river in a boat. BY THE SPECIAL MASTER: Q In the boats you had? A In any boat. Dave Rust came down river, he had canvas boats MR. FARNSWORTH: Let him tell about that. A You can't go. MR. FARNSWORTH: We move to strike out the witness statement that you can't go up the river in a boat, on the ground it was not responsive to any question, as I recall he question. Whether it was or not the competency of this wit-ness to testify as to that as not been shown. He was on that stretch of river only twice in his life. However memorable those occasions may have been, he has had no experience on the river in going up and down it, never has tried to go up it, knows nothing about it except his trip down at this par-ticular stage of water when he happened to do down. I do not think he is qualified to testify. THE SPECIAL MASTER: I think he is competent to testi-fy as to whether in his opinion he could go up the river at that |
