Show Prommel- D 1006 upon the ground this witness has not shown any competency to testify concerning river navigation on the Colorado river. We object to it for the reason the rates that the Moab Garage Company happened to charge under existing conditions are no proper guide for any purpose, and are not a proper basis upon which to predicate a question that would throw any light upon the issues in this case. We object to it as calling for a conclusion of the witness with reference to a matter upon which opinion evidence, even if the witness is qualified, would not be competent. THE SPECIAL MASTER: I do not understand the question concerns itself with prices. As I suggested, I think the witness, from his past career in many varied lines as an engineer is qualified. I think the question is pertinent to the issue. I shall admit it, but under your objection. MR. FARNSWORTH: Note an exception. BY MR. BLACKMAR: Q Have you the question in mind? A Will you please repeat the question? ( There stenographer read the last preceding question as follows:) " You can ask him whether in his opinion this method of transportation or the construction of a road would be the more economical in case the oil well should prove to be of permanent value." 2976 |
