Show Blake- C 940 objected to it -- MR. FARNSWORTH: The witness testified to a boat that came from Mr. Woolley. If he was testifying from hearsay, and you knew it, you should ask him about it. THE SPECIAL MASTER: That doesn't follow, because counsel fails to object to hearsay that other counsel may inquire for hearsay. I don't understand the witness knows where the boat -- MR. FARNSWORTH: I don't contend I have a right to bring out hearsay because opposing counsel has; that is not what I mean, your Honor. On direct examination it was brought out from this witness and no suggestion of hearsay at that time, that this was a boat that had formerly been used by Mr. Woolley. THE SPECIAL MASTER: There was no suggestion of hear-say. I didn't happen to notice it. It evidently was hearsay. The witness evidently doesn't know where the boat was used from personal knowledge. MR. FARNSWORTH : It now develops -- THE SPECIAL MASTER: Ask him who told him about the boat, then you can get at it that way. BY MR. FARNSWORTH: The information you volunteered on your direct examination, that this was a boat that had formerly been used by Mr. Woolley, was information that came to you from some person telling you that it had been, is that correct? 2910 |
