Show -9- Court of the United States, and it is hoped that a decision thereof will be rendered by that court early in January: I respectfully suggest whether, pending such decision, it may not be better to wait this matter. Meanwhile, I respectfully request that you send to this Department the treaty in question, or cite me the same, so that its terms may be under consideration while we are investigating the question of fact which may also be involved, as to whether the action of the "Imperial Canal System" will have a tendency to impair the navigability of the Colorado. Caldwell, an official of this Department, was thereupon directed to make a personal examination of the facts and circumstances, as appears from the following letter: Department of Justice, Washington, D.
