Show 9. Said Andrade is hereby given and granted and privilege of cutting, hauling away and selling within three years from date hereof four thousand (4,000) cords of wood from the lands conveyed by him, or agreed to be conveyed by him, to party of the first part, in addition to such wood as may already heretofore have been cut and sold therefrom. 10. Party of the first part, as a condition on which rests all of the agreements of Andrade, party of the second part, further agrees to build and construct, or have built and constructed for it, a main canal from the Colorado River to the Salton or Carter River, for the purpose of diverting and carrying water from the Colorado to, into and through said Salton or Carter River. Said canal to be commenced not later than August 1st, 1900, and to be completed not later than August 1st, 1901. Section Three 1. The parties of the second part, for themselves, their heirs, executors, administrators and assigns, hereby grant and convey to the party of the first part the right to use forever the land constituting the channel known as the "Salton or Carter River," and such channel, throughout the length of such "Salton or Carter River," and especially such portion thereof as extends through and traverses the land now belonging to the parties of the second part, and lying South of the lands comprising the one hundred thousand acres heretofore conveyed to the party of the first part by the parties of the second part, together with a right of way over said channel or river, for the purpose of carrying water in such quantities as may be desired by said party of the first part; and the parties of the second part agree, upon notice, to |
