Show 1st.-A good and sufficient deed conveying to said Company the Northerly One Hundred Thousand (100,-000) acres of land situated in Lower California, and described in the contract of May 21, 1895, and referred to in the agreement of June 3, 1896; 2nd.-That the said Andrade will assign to the said California Development Company, the party of the second part, the colonization contract and concessions granted to said Andrade by the Mexican Government on the 27th day of February, 1897; 3rd.-That he, the said Andrade, will grant and transfer to the said California Development Company the right to use the channel known as the "Salton or Carter River" for the purpose of carrying water, and shall execute a conveyance of a right of way covering such portion of such channel as lies to the South of said One Hundred Thousand (100,000) acres and within the boundaries of lands now owned by the said Andrade for the purpose aforesaid, provided, nevertheless, and upon condition that the said California Development Company shall through its President or Secretary notify the said party of the first part of its acceptance of the terms of this agreement, and its desire to make the purchases here in specified on or before the 1st day of July, 1897, and give to the said Andrade its assurance of its ability to pay the said sum of Six Thousand ($6,000) Dollars on the delivery of the deed aforesaid, and in addition thereto, and at the same time execute and deliver to said Andrade the promissory note of the said California Development Company legally and duly executed by said corporation for the sum of One Thousand ($1,000) Dollars in gold coin of the United States payable on or before January 1, 1898, and |
