Show -21- for the irrigation of one acre shall not be sold at a less price than Two and 50/100 ($2.50) Dollars per acre. And it is further covenanted and agreed for such purpose and the Trustee shall, from time to time, upon application by the Company, if not in default for the period described in Article II hereof, in the payment of coupons of said bonds, and provided the Company shall have made the payments to the Trustee for the sinking fund which are herein provided to be made, release from the lien of this indenture all lands and water rights so sold, and execute and deliver to the treasurer of the Company suitable documents to effect such release. A certificate in writing signed by the President of the Company, containing a description of the lands or water rights to be released, together with a statement of the number of acres, or the amount of water embraced in such description, and the price received, or to be received, and a request to the Trustee to execute and deliver such release, shall be sufficient authority to the Trustee to execute and deliver to the Treasurer of the Company releases of such lands described in such certificate from the lien of this Indenture. It is further covenanted and agreed, however, that the Mexican Company may from time to time grant, convey and donate, free from the lien of this indenture, any of its lands now owned or hereafter acquired and not constituting a part of its main canal and the Company may, from time to time grant, convey and donate, free from the lien of this indenture, any of its lands now owned or hereafter acquired and not constituting a part of its main canal for any religious or charitable purpose, or as a remuneration or compensation to any Colonization Company |
