Show -22- II. That second party hereby agrees to extensively advertise such lands, water-rights and stock, and vigorously push the sale thereof as rapidly as it can be done judiciously, paying the expenses of such advertising, together with all expenses of showing lands owned by said Mexican corporation, and the lands upon which the stock of said water company is to be located, and furnishing the means whereby visitors to such lands will be able to reach the same and examine and inspect the same; and also to pay all expenses of surveying the lands upon which the waters of said Water Company are to be used, and all other necessary expenses connected therewith; and to conduct the entire business in a vigorous manner, just as though all the lands, stock and water-rights to be sold or leased belonged to the second party. III. For and in consideration of the services to be performed by second party hereunder, first party hereby agrees to pay to second party the following commissions, namely: On all sales of water stock, or water-rights or lands, belonging to the party of the first part, or to the Mexican corporation, and on all leases of land with water, the first party hereto shall pay a commission of twenty-five per cent, provided, however, that no commission is to be paid by first party to second party when the stock of any water company is exchanged for scrip of the California Development Company. In all cases where commissions are to be paid as herein provided the first moneys received on such sales or leases shall be equally divided between the parties hereto, until such commissions are fully paid, and the second party hereto is hereby authorized to retain its commission on the basis herein- |
