BLACKMAR: Does your Honor hold I can not show that after he made this investigation of the possibilities of transportation he arrived at a conclusion? THE SPECIAL MASTER: You can show what he did. I don't think what his conclusions are has any bearing. You can show what he did. His conclusions may be based on all kinds of things. MR. BLACKMAR: It would not be proper to leave it in the situation that he made the investigation, and then after he made the investigation that he hauled his supplies in overland, without showing why he adopted the overland trip in preference to the river. I submit to you a man here who has been engaged in freighting for a period of twenty- five years is perfectly competent to testify why he passed up one route in preference to the other. THE SPECIAL MASTER: How is it going to show one way or the other as to navigability of this river why a man did a certain thing? He may have done it for a hundred different reasons. The important facts are, did he investigate, what was the extent of his investigation, what did he do afterwards. |
