Show 4326 Loper- D 2346 comes in there ( indicating); I wouldn't swear to that being the Crossing of the Fathers. This ( indicating) breaks down as I told you. That is all I could really go on. THE SPECIAL MASTER: The witness can not identify it. THE WITNESS: I think it is, but I wouldn't say that it is. ( Complainant's Exhibit 404 was thereupon marked by the reporter.) BY MR. BLACKMAR: Q Mr. Loper, I show you Exhibit 404, which is a photograph, and ask you where that was taken, and what it represents. A That was taken at the foot of Honaker trail. There is a bend in the river there; that is where the sand waves would pile up so high; that would have been more than an open boat would have done, to have crossed the river at that place. Q Are those sand waves you see in that picture? A Yes sir. There is no rapid or waves there in ordinary water. BY THE SPECIAL MASTER: Q Is this looking up or down stream? A That is looking up stream. Q Are you sure of that? Do the waves curl backwards? A Yes sir. Q The crest of the wave falls up stream? |
