This witness has told in court a number of glittering generalities, in his direct examination, as led by counsel, and he used some illustrations, presumably to be of aid to this court. Whether his position is logical or is not logical, whether one would naturally suppose this or that from the testimony he has given, I have a right to probe him on cross examination. THE SPECIAL MASTER: I haven't any doubt on that question. MR. FARNSWORTH: I think I have a right to ask this question just in the form I have asked it. I merely want to get the witness's idea. I assume he will not attempt to avoid my question when he understands it. I think Mr. Loper will readily answer. THE WITNESS: I will have to answer it as I can answer it. Every time I start to answer it you stop me. BY MR. FARNSWORTH: Q I stop you when you get into something that is not an answer to the question. A I can't describe a bend of the river with a straight stretch of river. They are two different conditions. THE SPECIAL MASTER: Just a minutes. I think Mr. Farnsworth's questions are entirely proper on cross examination, and the witness will answer them as best he can. He can not |
