FARNSWORTH: If the court please, may I just add this,-- of course, as we contend, this evidence is all irrelevant, so far as any showing has thus far been made; It is incompetent even if it were relevant. By sitting by I do not want to waive any objection I may urge to it later. I don't want to take up a lot of time making objections to all this testimony. SPECIAL MASTER: WHAT evidence do you specify? MR. FARNSWORTH: This testimony about conditions up there in New Mexico at a point far removed from the sector in question, with nothing to indicate it throws any light upon the controversy in this cause. SPECIAL MASTER: You mean the testimony of the last five witnesses? MR. FARNSWORTH: Yes, just these last witnesses, who merely testified to conditions up around Farmington. SPECIAL MASTER: I have already intimated it is difficult for me to see the relevancy, but Mr. Blackmar states he can show some material connection. If he does, I believe it will be relevant. At the present moment I have not been able to see how conditions one hundred and fifty miles away from the locus aid us very much to decide the navigability of the river below there. MR.
