Show Chapter V - The Colorado River Storage Project Act Chapter V refers to the Colorado River Storage Project Act, its major components and power contracts. Its text appears in Appendix 1 H.I. Chapter VI - General Principles to Govern, and Operating Criteria For, Glen Canyon Reservoir (Lake Powell) and Lake Mead During the Lake Powell Filling Period Chapter VI recites the genesis of the "Filling Criteria" promulgated to control the impact on downstream water users and power customers of water storage in Lake Powell and other Upper Basin storage projects. The text appears in Appendix 602. Chapter VII - Operating Criteria Chapter VII describes the background of the long-range operating criteria for reservoirs on the Colorado River system. The text appears in Appendix 701. Chapter VIII - Arizona v. California A summary of the dispute which culminated in the litigation and a summary of the Special Master's Report is provided in Chapter VIII. This includes a discussion of the prior litigation, the principal issues, the various arguments, the Master's principal conclusions, Winter's Rights Doctrine for Indian and Federal reservations, mainstream allocations, and present perfected rights. Because of its length (361 pages plus 72 pages of appendices), the text is not included in the Appendices. Chapter IX - Supreme Court Opinion - Arizona v. California of June 3, 1963, 373 U.S. 546; and Decree of March 9, 1964, 376 U.S. 340 Chapter IX contains a summary of the Supreme Court Opinion in Arizona v. California, the reasoning of the Court in considering the various contrary arguments, where it agreed with the Special Master, and where the Court disagreed with and reversed the Special Master. The Decree is discussed in Part J of Chapter I hereof. The texts of the Opinion and of the Decree are included in Appendices 901 and 902, respectively. Chapter X - Present Perfected Rights Chapter X provides a narrative statement of the background of present perfected rights, the lengthy negotiations leading to a proposed stipulated determination, the objections thereto of the Indian Tribes along the river in the Lower Basin, the proposed compromise stipulation, and the Supreme Court Opinion of January 9, 1979, approving the proposed Decree. The texts of the Decree and the Supreme Court Opinion of January 9, 1979, are included in Appendix 1005. vi |
