Show 4. Close the dry washes, within the Grafton Historic Reserve and the historic Wood Road on public lands to off road vehicle use and camping as well as install appropriate signage. (see attached map) Work with Town of Rockville to close the historic Wood Road to motorized use. Administration of the Agreement 1. Nothing in this agreement or in any plan shall be construed as obligating any of the parties to expend money in excess of appropriations authorized by law and administratively made available for this work. 2. It may be necessary from time to time to cooperatively develop special rules or ordinances needed to provide for public safety or for the maintenance and protection of the Grafton Cemetery area; development of such rules or ordinances will be conducted through appropriate administrative and public processes applicable to the parties. 3. No contribution, donation, or gift of any kind shall entitle the contributors or donors to any share or interest in the Grafton Cemetery area, its resources, or improvements other than the right to use and enjoy the same under the then existing rules and regulations applicable to the area. 4. Equipment or facilities donated to the Grafton cemetery or purchased through contributed funds become the property of BLM. Natural improvements such as nati ve plants, and other landscaping which shall be and will remain the property of the BLM. 5. This agreement shall be effective upon execution by all parties and subsequent filing with the respective custodian of public records of each party in accordance with Section 1113-10 of the Utah Interlocal Cooperation Act, and shall continue in accordance with the terms and conditions herein provided, but in any event shall terminate 10 years from its effective date, unless renewed with the mutual consent of all parties. 6. This agreement may be amended or revised as necessary by mutual consent of all parties, by the approval of a written amendment, signed and dated by all parties. 7. This agreement may be terminated by the mutual consent of all parties under terms and conditions mutually satisfactory and as documented in writing. Otherwise, any party may terminate this agreement by providing sixty (60) days written notice to the other party; BLM shall initiate termination only with cause and after opportunity for comment from the other participants in the agreement, and appropriate administrative review. 8. Upon termination of the agreement and satisfaction of outstanding obligations, any remaining contributed funds shall be retained by Partnership to be used for purposes within the Grafton town site for maintenance or restoration as appropriate. Restoration of BLM lands shall be completed to the satisfaction of the BLM' s authorized officer. Facilities remaining on unleased public lands after termination of this agreement and required restoration has been completed shall become the property of the United States. |
