Show Purpose 1. Establish a long-term partnership between the BLM and the Partnership for the management and maintenance of the Grafton Cemetery and surrounding identified land located in the Town of Rockville. (see attached map) 2. Facilitate development and implementation of planning and management decisions involving the Grafton Cemetery through a process that best combines the resources and authorities of both parties to improve conditions and to achieve established goals for the area. 3. Provide for public input into management of the area in compliance with the National Environmental Policy Act of 1969, the Federal Land Policy and Management Act of 1976, and Utah's Open and Public Meeting Act (Utah Statutes 54-4-1 through 54-4~9). Authority 1. Bureau of Land Management: Section 307 of the Federal Land Policy and Management Act of 1976 provides the authority to enter into cooperative agreements involving the management, protection, and development of the public lands. 2. Grafton Heritage Partnership: Grafton Heritage Partnership Resolution No. 2003 authorizing Partnership officials to enter into a cooperative agreement with BLM for the management of the Grafton Cemetery. Responsibilities and Provisions The Grafton Heritage Partnership agrees to: 1. Provide community assistance within the means of the Grafton Heritage Partnership to manage, enhance and maintain the Grafton Cemetery and surrounding land for the benefit of the public who visit the area, such assistance may include the contribution of funds, materials, or human resources. 2. Solicit volunteers who will assist in routine cemetery management and maintenance such as litter control, gate closure and report to officials when incidents or violations are observed. 3. Notify the BLM in writing for all proposed activities involving restoration, rehabilitation or revegetation on BLM land. 4. In accord with Section 106 of the National Historic Preservation Act as amended, consult and seek technical advise with the Utah Division of State History for all proposed activities involving rehabilitation of the Cemetery. The BLM agrees to: 1. Provide planning and technical expertise to assist in the preservation and management of the site. 2. Contribute materials or human resources within the means of the St. George Field Office, to accomplish the goals and objectives of this agreement. 3. Provide law enforcement assistance and coordination within the means of the local BLM organization to deal with issues related to human safety and violation of applicable laws and regulations. |
