A fellow by the name of Steve Ped~ar, who was the head of the ACLU region, who offices in Denver, or was then - I don't know what he does today, he tried that case and it was in newspapers. So, I wrote him a letter and told him that I wanted all of his pleadings and everything, and I wanted his briefs and stuff like that. He sent it to me and invited my comments on it. What had happened was that he'd asked for an immediate injunction to prevent things being handled that Christmas. Those songs? The program being put on with those songs in it. The judge came down with a ruling about 10 days before Christmas and said that would not rule on that matter until after Christmas because he didn't see that any harm could be done one way or another, whethe he restrained it or didn't restrain it for one more Christmas. Now, here I'd already been talking to Ped¢ar on the telephone and that's when I told him he was going to lose because ir he was right and if the judge believed he was right, then he wouldn't le that program go for once more, period ••• he would cut it ·out. He said, "oh, you can't be right. We're going to win that thing ... Then is when I voiced an objection I previously raised. Ped¢ar' attack was directed at those 4 rules, and I argued with him that the rules may or may not be constitutional, and the attac~ should |
