Preparation of Environmental Impact Statements on System by System basis for Bonneville Unit The Bureau of Reclamation is in process of preparing a Draft EIS on the Jordanelle - Provo River M S I System of the Bonneville Unit of the CUP. They plan later to prepare an EIS on the Utah Lake Irrigation System, followed by or preceded by an EIS on the Diamond Fork Power System, However;- - in order to be authorized by Congress for construction, the Bonneville Unit, in toto, had to be demonstrated having economic feasibility and^ a cost/benefit ratio acceptable to Congress. Both these were arrived at for the total Bonneville Unit on the basis of combining M S I water development and power development to offset the low returns from water developed for irrigation. Congress authorized the Bonneville Unit on the basis of its feasibility as calculated by Bureau of Reclamation economists. . as a total Unit. However, Utah Lake diking, for purposes of arriving at an "Exchange" of water (saved from lesser evaporation from the smaller sized lake) from the proposed Jordanelle Reservoir, is an integral part of the Jordanelle-Provo River M S I System. The two cannot be separated. Compliance with NEPA requires EIS preparations to cover the comprehensive projections of the Project; for purposes of EIS preparations for public review, Project parts cannot be segmented. ( This was legally upheld in the Sierra Club Suit versus BLM and the Colorado Water Board.) the Bureau of Reclamation is using as guidelines for this segmented EIS preparation, the Suit - Sierra Club versus Stamm, June 21, 19 74. One of the major underlying premises of this suit was the assumption that water was not available to meet Bonneville Basin water needs without CUP developed water. The two enclosed legal opinions of County Attorney Paul VanDam in addition to his reports to the Salt Lake County Commission, refute this premise. We would appreciate an opinion from the Department of Interior on the issue of the legality of the proposed Draft EIS for the Jordanelle- Provo River M S I System |
