BLACKMAR: I offer those two exhibits. THE SPECIAL MASTER: So far, Mr. Blackmar, as wells are drilled above high water mark, the evidence would not have any bearing on the allegations of the government as to the occupation or possession of the bed of the stream, would they? MR. BLACKMAR: Probably not, on that particular point. MR. FARNSWORTH: I will say to the court at this time, that when our answer was drawn the state had made no survey, and we except to investigate the fact; we have not yet done so; we except to investigate the fact, and if we find that a denial contained in our answer is improperly made, we will make a proper admission on the record. THE SPECIAL MASTER: I called Mr. Farnsworth's atten-tion this morning to the fact the allegations, of the plaintiff's petition and the denial of those allegations, so far as they were contained in paragraph 7, go to the question of the jurisdiction of the court in equity, and do not apparently go to the question of the navigability of the river, and it occurred to me counsel might possibly arrive at some stipula- |
