MR. BLACKMAR: My principal idea about putting this in deals with operation of the boat, the Undine. There is a newspaper article in there in which it recites the day the Undine left Greenriver, and then there is another news article - THE SPECIAL MASTER: Now, the Undine was run, if she was run, in 1901. We are hardly getting back in a historical era. You have plenty of witnesses, or you have had some witnesses who testified to her running, and you have Mr. Taylor here. I doubt very much whether newspapers of twenty- eight years ago are competent evidence of facts. MR. BLACKMAR: With particular reference to the Undine, the only thing we have been able to show is the wreck of the Undine, as testified by Mr. Clark. We have no evidence and know of no witness by whom we can prove-- THE SPECIAL MASTER: Can't you and Mr. Farnsworth stipulate such facts regarding the Undine as you can find in that paper? MR. FARNSWORTH: If that is introduced in evidence I take it there will be no inclination on either side to encumber the record with any recitals in there that are not |
