There are certain allegations in government petition which it raises in order to found its right to bring a suit in equity at all, and those allegations to some extent have been denied by the respondent. It occurred to me counsel might possibly arrive at some stipulation on that point in order to dispose of the question of the right to maintain a bill in equity. MR. BLACKMAR: It would be most unfortunate if this case should eventually go off on a question of jurisdiction. THE SPECIAL MASTER: Yes. But that is one of the questions in the case on the pleading as it now stands, or may be one of the questions, because certain facts which may be necessary to establish the right to maintain the bill to quiet title are, as the pleadings stand now, denied. I merely suggest that at this point so counsel may consider the possibility of a stipulation as to such facts. Now you may proceed. BY MR.
