Show 4956 Edwards- D 2969 that section up above mean high water mark at places where, on the government map, according to the government survey, the particular well is below mean high water mark? A I am unable to say that. MR. FARNSWORTH: I should think the government sur-veys would be a better guide to the court than a map prepared by a private company, at the time interested in the precise question. Perhaps goes to credibility. BY MR. BLACKMAR: Q Where does this map show Frank Shafer No. 1,-- below or above the mean high water mark? A Above. BY MR. FARNSWORTH: Q AND that is true of No. 2, also? A Yes sir. Q How far above does your map show No. 1 Shafer well to be? A Approximately sixty feet laterally. There is no contour here, so I am unable to judge from the map how much above in elevation it is above the mean high water mark. THE SPECIAL MASTER: I think the maps better go in for what they are worth. They show what the company con-tended, if that is of relevancy. BY MR. BLACKMAR: Q What does Exhibit 466 show? |
