We expect, if we have a desire to offer something similar, you will make no objection to ours. MR. BLACKMAR: That goes as to all newspapers. THE SPECIAL MASTER: Mr. Farnsworth may have no objection, but I may have. What does this consist of? Simply because an article appeared in a newspaper doesn't guarantee that it contains facts. I assume we were trying this case on facts. Now, simply putting in the files of a newspaper proves nothing. MR. FARNSWORTH: I have only looked at probably half a dozen of those articles. Just started to scan it last night, and decided I wouldn't go any further. I could think this, your Honor, that news items, especially of an early day, appearing from old files, was competent evidence, and might be a value, decided value. THE SPECIAL MASTER: On the theory that it is a historical writing. I think that is true; but it is not every newspaper article that purports to contain facts. I am making these remarks with no intention to have them derogatory to the newspapers in general, but I do not conceive |
