Show 111. AuguSfi"ioj 1920: The Secretary reported the following communication from Attorney General Dan B. Shields: June 17, 1920. Rs: "Mr. Elbert D. Thomas, Insurance for Students Doing Secretary-Registrar, University, Salt Lake City, Utah. Dear Sir: Erectical Work in School of Mines. "This office is in receipt of your communication of June 9th, relating to students who do practical work in the School of Mines. Ybur inquiry as to whether it would be prOper to list these students on the regular semi-annual report to the State Insurance Fund, should, be answered in the negative. in our opinion, The Workmen's Compensation Actdoes not provide for the listing of students, and in our Opinion the law could not be construed so as to regard these students as employees of the University. Neither, in our Opinion, could they be regarded as mine employees, even tho the mines should permit them to do practical work as a part of the regular course in the School of Runes. But, in any event, if they shofild be regarded as employees of the mines, they would, nevertheless, come under the subdivision of Section 5111, Compiled Laws of Utah, 1917, which provides, "....but not including any person whose employment is but casual or not in the usual course of trade, business, profession or occupation of his employer". You seem, therefore, to be confronted with the prOposition of being compelled to make the best arrangement possible with the mine owners for the practical work We, of course, cannot solve this required in your course. justified in taking the position feel we but you, problem for that the University is not authorized to expend the funds of the state for the insurance of these students. We might offer this suggestion by way of solution, that the students themselves, contract with the mine owners to assume whatever risk is entailed in their mine work." Very truly yours, Dan B.
