Show 80 "Pursuant to the will of decedent, the Executor has converted all Of the Property into available assets and has transferred and delivered te the same to the University of Utah, which amount in the aggregate to the sum of $41,542.04, including (lv p5,000.00 which was received from Dr. Park's estate in the State of Idaho. Final Report John R. Park Estate D . "Heferring to the Idaho estate: Dr. Park left an estate con31st1ng of 640 acres, which he obtained under the United States Desert Entry. This land was unimproved. He had not, prior to his death, completed the necessary proof to secure his water rights for the reclamation and irrigation of this land. This proof was thereafter supplied and completed by the Executor. The land was approaised, as shown by the inventory and account (which inventory is hereto submitted) at $10.00 per acre. Annie F. A. Hilton, upon learning that the Doctor had left real estate in Idaho, filed a claim in the Idaho Probate Court for one-half of said estate. (The widow under the Idaho Statutes The is entitled to a one~half interest in all real property). Executor contested her claim and the issues were found in the Probate Court in favor of Hrs. Hilton. From this judgment the Executor appealed to the District Court of Idaho and from the Said Supreme Court District to the Supreme Court of that State. held that hrs. Hilton was the lawful widow of decedent and thereupon 520 acres of the said 640 acres, including one-half the water rights appurtenant to said lands, were awarded and set apart to . Mrs. Hilton. "The Executor, after adjusting the water rights, which were involved in litigation, sold the remainingJZZO acres, which sale was approved by the Court, for the sum of $5,644.80, which, with the accrued interest, as shown by the final account herewith submitted, constituted the total assets of the Idaho estate. After paying all claims, costs and charges of administration, it left a balance of $5,000.00, which has been paid to the University of Utah, as shown by said final account.
