First, I have noticed up the deposition of Clark Johnson for BQbruary 20, 1974, at 9:00. I have a trial this week and David is going to be out of tw^n Thursday through Monday, so that was the earliest time we could coordinate our schedules. Secondly, one of the enclosures is a rough draft of Clyde's motion for leave to intervene. This has not been filed as yet. However, filing appears to be imminent. Third, enclosed please find Bill Lockhart's intital effotts on behalf of the Indians. Fourth, please find a letter from a group known as the Affiliated Ute Citizens of Utah. Also find my initial inquiry to Parker Nielsen. Fin Finally, enclosed find an itemized bill as requested. I concur with your comments regarding the taking of Clark Johnson's deposition. Rather than take the deposition of two individuals to start with, I have noticed up Johnson's because he is the head man. I don't have the name of anyone else whose deposition I might take whose testimony would not be redundant to Johnson's. I have followed your suggestion and not subpoenaed documents, however Dave |
