ANTHONY RUCKEL Staff Attorney, Denver February 13, 1973 Mr. David Raskin Conservation Chairman, Uintah Chapter Sierra Club 1865 Herbert Avenue Salt Lake City, UT 84108 RE: Central Utah Project Dear Dave: I expect shortly to again review the entire file on this matter and confer with you and others. In the meantime, however, I note that your recent "Dear Conservationists" letter in its fifth paragraph stated: "The (SCLDF) has authorized legal action against the (Bureau) if the Final Environmental Statement fails to comply with the law." This in incorrect, and, to the extent possible, those people who received your letter and may rely upon it should be so notified. Authorization of legal action by the Sierra Club only occurs upon action by the Board of Directors or their Executive Committee or designate. It is the role of SCLDF to propose to that body upon receipt of requests for action from local chapters and regional conservation committees. At the current time SCLDF is in receipt of formal request from the Uintah Chapter and SWRCC to review the matter. This we are doing. However, no legal action has yet been authorized and will not be authorized until formal proposal to the Board. I hope that no difficulties will result from that statement in your fifth paragraph. However, if such do develop, please let me know and we can confer on how to deal with them.
