As I am sure you realize, speed is of the essence. February 4 misses by two days the instructions of the Federal Rules of Civil Procedure that depositions should not be taken within 30 days of the filing of a complaint. The Rules provide for application to the court for waiver of the Rules, and we have so applied. I will let you know as soon as we obtain the court's consent. The 30 day Rule applies only upon motion and use by that person served, or a party to the action. Therefore, please institute service procedures even if you have not yet heard from me regarding the court's agreement. One thing I have not mentioned over the phone is our need for a court reporter. It will be necessary to have the deposition transcribed by Friday, February 8, 1974, and in the mail on that day to all parties. Naturally, we will pay any additional charges required for expedition of the transcription. Tell the reporter that he or she will probably have to figure on a whole day. Confirm with the reporter by letter for services and enclose in the letter a copy of the notice of taking deposition. Send a copy of that letter to me. Finally, please do not call the outfit named Alderson Reporting Company, Inc., the people you fixed rae up with for the Bridger deposition. I would prefer practically anyone else.
