SILVER Staff Attorneys, San Francisco H. ANTHONY RUCKEL Staff Attorney, Denver February 12, 1974 Mr. Andrew F. Walch General Litigation Section, Land and Natural Resources Division Department of Justice Main Justice Building Washington, D.C. He: Sierra Club, et al. v. Stamm, et al., Civil Action No. C-74-9, U.S. District Court, Utah Dear Andy: I am informed (unofficially) that the preliminary injunction motion in the above-captioned matter will be heard before Judge Ritter beginning at 10:00 a.m. on February 28. I repeat here my request made at Nat Reed's deposition in Washington that you consider continuing opening of bids for construction of Currant Creek Dam until the trial judge has the opportunity to make a dispositive ruling in the case. This would have the great advantage to all of us of avoiding the need for a preliminary injunction hearing. Assuming the hearing will take place as scheduled, I have, at this time, a few important requests and observations. First, I request of you stipulation into evidence of the Indian Deferral Agreement of 1965, together with attachments, as incorporated in our memorandum in support of our application for preliminary injunction. I also request stipulation into evidence of the Final Environmental Impact Statement attached to the affidavit of David Raskin and filed with the court.
