Like all first drafts, I do not represent the thing to be completely in order, and, in fact, I am sending my work out at this stage for the express purpose of receiving criticisms and comments you may have. The Second Claim is especially rough. The Claim has not been directly made before, although a few cases have mentioned it. See Fred Anderson's NEPA in the Courts, pages 125-133. Fred suggests difficulty in termT"oF"requesting relief. I concur. Nevertheless, I think effective relief can lie under the Second Claim that is couched in terms of a mandamus writ or a mandatory injunction. I would appreciate your specific comments here.
