Show I Mr. John D. Leshy November 26, 1973 Page 2 is very critical to the entire picture. It is the first impoundment structure for the Strawberry Aqueduct, that aqueduct which would eventually extend for mile after ipile eastward toward the Green River gulping up every stream draining south from the Uintahs in its path. Along this aqueduct would be the very damaging Upper Stillwater Reservoir on Rock Creek. In addition, the Strawberry Aqueduct would carry water from the climatic Uintah Aqueduct which would cross the Uintahs from Flaming Gorge to land in Upper Stillwater Reservoir. All in all, little Currant Creek Reservoir, all 15,500 acre feet of it, is the first step in the whole diversion process. It is the judgment of the people on the scene that we must proceed against Currant Creek Dam. I am in complete agreement. All arguments made in my CUP II Memo of October 17 hold for the Currant Creek Dam. Secretary Morton sent out specifications for bids on November 8| however, bids are not taken up until February 5, 1974. I have discussed this time frame with our local counsel Curtis Oberhansley of Salt Lake City. We have tentatively set Monday, December 17 as the deadline for filing our Complaint and Motion for Preliminary Injunction. We have not yet made a determination on whether we should file a TRO, but certainly expect to prior to December 17. Our intent, of course, is to leave plenty of time to obtain a preliminary injunction hearing in District Court prior to February 5, 1974. I expect to have the first draft of Complaint prepared and ready for circulation early this week. I shall certainly send you a copy. I am pleased that your principal interest, the "Divide and Conquer" Bureau of Reclamation development patterns, is also one of our principal concerns.
