Show • December 21, 1973 Tony Ruckel 508 Majestic Building 209 16th Street Denver, Colorado 80202 Dear Tony: Thank you for your letter of December la, 1973. David and I have discussed many of the matters raised therein regarding appropriate affidavits and David has some excellent people in mind that would perhaps be willing to assist in such manner. Prior to my leaving, I wanted to impart one additional thought regarding preliminary relief. David was suggesting that we could use certain interdepartmental memoranda from Nat Reed and otherswkhich were addressed, I believe, to the Assistant Secretary of Interior. All of these recommendations rather strongly urged that no further construction be undertaken until a complete and thorough study is accomplished. David wants to use these memoranda at trial and I indicated that there may be a problem with getting the opposition to stipulate to introduction of the documents or getting the court to take judicial hotice thereof. In other words, it may be necessary to subpoena Nat Reed. However, we may be able to introduce these documents as support for the opinion of the fish and game men that you mentioned. In other words, what stronger affidavit could we hope for than a fish and game man stating that the presently donceived project is a disaster and that this opinion is shared by most of the people in his department infciuding the Assistant Secretary for Fish, Wildlife and Parks in Washington, D.C., Nathaniel P. Kced, with a copy of all of Reed's memoranda to Morton and other assistant secretaries within the Department of the Interior. This would certainly be strong supporting evidence for a temporary restraining order. If we were able to complete such a maneuver, |
