Show 4692 Kirkpatrick- C 2706 Q How do you know that the mud began six inches below the surface on the one or more occasions, whichever it was, when your horse went up to his belly? A I don't know. Q You don't know? A No; don't know where the mud began, or where the sand. Q Then when you said the water was only six inches deep and the mud represented the balance off the depth when that horse went up to his belly, you stated what you don't know; is that correct? A No; I know there was mud in there. Q That is not what I am asking you. You gave us a depth of water at that point and said the water was only six inches deep, the rest of it was mud? A Yes. Q Now, you just state you don't know how deep the water was. What is the fact? A I believe the water was six inches deep. Q Do you believe that for the purpose of this case, or do you believe it because you made any observations? Q Then could you see the mud? A I could when the animal came out on the land with the mud all over his legs. |
