Show 4689 Kirkpatrick- C 2703 mis- state his testimony. He said the water came up that far on the horse's legs. MR. FARNSWORTH: I am not mis- stating his testimony. I object to counsel interrupting, and suggesting to the witness. I think it is improper that he should interfere. I have the right to put the question this way on cross examination. I will re- frame the question. BY MR. FARNSWORTH: Q It is a fact, is it not, according to your recollection, as that incident comes back to your mind now, you saw the water of that stream as you forded through the channels come two- thirds up the legs of the animal you were riding? A Yes, and more than that. Q All right, how much more than that? A Up to the horse's belly. Q Up to the horse's belly. Would the depth of the water be up to the horse's belly in several places as you went over? A I couldn't say as to that Q You know the water was that deep in several of the channels that you forded?
