Show 718 APPROVAL OF RESOLUTION CONCERNING DECLARATORY JUDGMENT of Utah directed that all biennial appropriations for the institution be paid over to it by the Treasurer of Utah quarter yearly in advance on Auditor's warrants, and that said appropriations, together with all fees, collections, and profits from proprietary enterprises, be expended by the Board of Regents in its management and control of the affairs of the institution free from supervision and control of any other agency, department, commission or official, which law was confirmed and perpetuated by Section 4, Article X of the Constitution of the State of Utah, and ‘ WHEREAS, the Board of Examiners, the Commission of Finance, the State Auditor and Treasurer are now, and for a long period of time have been, disregarding and violating said law and constitutional mandate by requiring that all monies received by the university from any source whatsoever be' paid in to the state treasury at the close of the months of June and December of each year to be later withdrawn therefrom, together with all appropriated monies, on requisitions supported by verified itemization of bills for the previous month which are pre-audited "by the Finance COmmission, allowed or disallowed by that body and then transmitted for review by the Board of Examiners, thereby, through command of its pecuniary resources, depriving the Board of Regents, as fathers and guardians of the institution, of'the management and control of the same, and WHEREAS, further friendly acquiesence and submission to such usurpation of authority over the affairs of the university by the various boards, commissions and officers, aforementioned, is rendered increasingly impossible as the population of the state grows, the enrollment at the university increases, outside controls tighten, and the disparity in technical knowledge respecting educational policies and requirements widens between the state's political agents and the university's constitutional authorities, NOW THEREFORE, be it RESOLVED that the proper officers of the institutiOn be, and they hereby are, authorized, empowered and directed to make requisition and demand upon the aforementioned administrative agencies and officers that there be turned over, delivered and paid to the Board of Regents of the University of Utah all the unexpended balance of the legislative appropriation to the university for the biennium 1949-51 and, also, all collections, fees, and profits from proprietary enterprises belonging to the institution which are now in the state treasury, and, in the event that |
