Show 3223 Dent- D 1248 have the benefit of my objection now, following the interpretation given by the witness of his answer, we move to strike out the answer of the witness on the ground that it is irrelevant and immaterial. We also separately move to strike the answer upon the ground that the competency of this witness to make the answer has not been shown. We move to strike it out upon the further ground that the answer of the witness is an expression of the conclusion of the witness with reference to what constitutes commerce of the character indicated in the question, and that such expression by the witness of his opinion with reference to the existence of other rivers with reference to existence of other rivers carrying such commerce is incompetent for any purpose. We move to strike the answer of the witness upon the further ground that the evidence fails to show that the physical condition upon the other rivers which the witness has in mind, or the geographic location of such rivers with reference to communities and places to and from which commerce may move, is at all the same as that present on either of the rivers in question here, and for the reason last stated, the answer of the witness is incompetent, and it also is irrelevant and immaterial.
