BLACKMAR: Q Colonel, turning to these words, " Commercial navigation", which I used, in your opinion are the operations of the boat of the Moab Garage commercial navigations? THE SPECIAL MASTER: I exclude it. MR. FARNSWORTH: Did your Honor say it was excluded? THE SPECIAL MASTER: Yes. MR. BLACKMAR: Does your Honor hold I can not ask this witness that opinion -- his opinion on that? THE SPECIAL MASTER: I think so. MR. BLACKMAR: We note an exception. MR. BLACKMAR: I now offer to prove by the witness on the stand that he has been present during this hearing and has heard the testimony with reference to the operations of the boat of the Moab Garage which transported oil well supplies from Moab down the river to several different points, and that in his opinion, owing to the excessive freight rates charged, also that the operations were of a temporary and of an explorative character, that such navigation or operation of the boat is not, in his opinion, commercial navigation.
