I have discussed changes of plan and purpose in this Unit in my letter to Guy Martin. I haven't had substantiation of the Bureau exceeding its authorized cost ceiling from OMB yet, however. I am sure that the "Compact" proposal of the State of Utah, as explained in the yellow sheet enclosed, is based on two issues: (1) action recommended in a Utah State University study on the feasibility of accelerating the Project construction and (2) obtaining Congressional authorization of the "Ute Indian Issue",which includes the CUP, which will override legal challenges on changes of plan and purpose and exceeding the authorized cost ceiling. In addition, I am sending background information on the sale of well water in the Delta, Utah, area by water suppliers and their farmer stockholders to Intermountain Power Project,for $1,75*0 per acre foot, of some 40,000 a f of water. Gerry Kinghorn has supplied the information but must be protected as the source of*this. He wrote Harris Arthur, Interior, at Arthur's house address, at Arthur's request, so Arthur could contact a Justice Dep't friend re- the legality of the water negotiation. Brent had said he would contact the Justice Dep't - so I don't know who will do what from here on in. The point of this issue is that the Bonneville Unit Strawberry Collection transbasin diversion System was planned on the premise of supplying 118,000 a f of the 136,000 a f of water to be transported - for irrigation purposes. Now the Bureau states that the Straw. Coll. System is an M & I System and water will be allocated subsequent to construction of the Project. This means that what surplus water is not contracted for M & I use |
