Show {\&q9 ?H (HI David, we are like tiny ants under the feet of an elephant in our efforts on the CUP. From that perspective, our efforts appear to be minimal. However, I think, that by utilizing available State and Federal regulations and opportunities ^^L. ^ W V TU to which the Bureau and the Water Conservancy Pistrictymust' v co-operate and comply, we, the public, have a power base which we must learn to use effectively. CRCUP has not utilized these options available to it. I have outlined these in.the letter to Hartt as well as in the pink letter to CRCUP members. I am suggesting to Barbara Polich,(Audubon Society, ^ n and Attorney), that she specialize in water quality issues for '1*0 li^sy^ CRCUP and for Audubon, and familiarize her self with legal ramifications of the existing Federal and State laws. I don't know whether she will do this. Gerry Kinghorn and Lee Kapalosky both have solid background knowlege in this area as well as Si c (Jih i n t h e imPiemen^ting of* these laws but both are limited in u > W / time. I think this aspect of CRCUP involvement is very and needs development. I have suggested she meet with Gerry and Lee at luncheon meetings frequently, to start building Co) <r?i up a legal background and the realities of EPA implentation. t ^ *+-/2.iy I think it would be valuable if you and Hartt could meet with this group on some basis. I think the time is past when you can only appeal to the Governor or the Conservancy District for instream flow resources you want. You need to undergird your appeals with existing laws and regulations. If Barbara won't do this, then I think we need to find some other person who will concentrate on this particular aspect of water management. Fred has his hands full in the overall CRCUP activities and in the arena of biological needs of streams. He has excellent contacts in this area. It is the area of legal obligation and possibility in which CRCUP is neglectful. You and Hartt might work as a Committee giving direction and use to this aspect of the CUP issue. It would be erfromously valuable if Barbara, who is an attorney, and who knows both Kinghorn and Kapalosky, could be the focus of this particular need and effort. See what can be done. I've made recommendations to Hartt, in the enclosed letter to him, which this Committee then needs to work on. There are several serious issues developing on questions of re-authorization of the Bonneville Unit from change of purpose and exceeding authorized cost ceiling and the sale of 40,000 a f of water to IPP. I am following up with my Congressmen, with EPC, EDF, NRDC, National WiUlife Federation, etc. to determine future action needed. So is the Sierra Club. So, don't be discouraged. I will have to submit a bill for costs of reproducing background material I have used as well as necessary phone calls. (.05 per copy in Manitowoc, .02 per copy oyer lo copies in Madis. on). I feel that my effort has been^aluable and supplements efforts you people are making in Utah. I do not know any way to perform my end of the effort, other than ways I have used. |
