Show 7542 5520 Mr. Farnsworth asked him certain question regarding the removal of rock, and then the Master asked a question: " What draft boat, in you opinion, could be run on the Green river if rocks were removed?" I will say now that was answer improper question asked by me, should not have been asked, and I withdraw it, although I proceeded to ask if it was objectionable to anybody, and Mr. Blackmar said it was not, -- I am convinced that it was answer objectionable question and should not have been asked by me. I remove it; I strike it from the record; and I strike the witness' answer from the record. Later on it the examination Mr. Farnsworth asked certain question regarding a program, possible program of improvements that might be undertaken, and the witness made certain answers regarding wing dams. I see nothing else in Mr. Wolverton's testimony regarding improvements or possibility of improvements of the conditions in the river. Since last evening, -- yesterday afternoon, rather, -- I have examined the cases in the Supreme Court which have passed upon the question of navigability, and also a number of cases in the inferior federal courts. I can not find that any evidences has been admitted as to the effect of possible improvements of a river subsequent to the date which was in |
