THE SPECIAL MASTER: I have a recollection of Mr. Wolverton's testimony, and the reason I asked Mr. Garnett to transcribe was that I feared that I, personally, had asked a question that I on further consideration should not have asked. That is why I had the transcript carefully made, but I am satisfied that this is all the testimony that Mr. Wolverton gave regarding the effect of navigation on this river by any improvements, and if there is anything in Mr. Wolverton's testimony, whether in this portion transcribed or otherwise, that has any reference to the question of navigability in an improved condition of the river, I will strike it out when the final transcript is given me. Now, that ought to cover the whole situation. MR. BLACKMAR: In view of your Honor's statement, I think we are content to rest it here. THE SPECIAL MASTER: Then that closes the evidence in the case, gentlemen, as I understand it, on both sides. MR. BLACKMAR: We are through. |
