Show 7503 Yokey - 5482 H. T. YOKEY, a witness heretofore duly sworn herein, was called to the stand as a witness in rebuttal, and testified further, as follows: DIRECT EXAMINATION BY MR. BLACKMAR: Q Captain Yokey, when you were on the stand before you testified about certain government survey supplies which were taken from Halverson's ranch, and there seems to be some testimony in here that maybe they started at Wimmer's ranch. Will you explain that, please? MR. FARNSWORTH: We object to that as not rebuttal. THE SPECIAL MASTER: Why not? MR. FARNSWORTH: We object to it as not proper rebuttal. THE SPECIAL MASTER: Why not, Mr. Farnsworth I don't know what he is going to testify to. MR. FARNSWORTH: I think counsel now rests under the duty of indicating the nature of the testimony, and of the evidence it rebuts. This is apparently testimony that was perhaps a part of their case in chief - THE SPECIAL MASTER: I am a little embarrassed with this, because I myself asked to have the conflict of testimony removed. |
