Show 7554 5532 THE SPECIAL MASTER: Now, with reference to the then we will discuss it informally -- In submitting the briefs or an oral argument in the case I would like counsel, in addition to the questions of law suggested by counsel in their respective opening remarks, to give some special consideration to the following questions which have not been as thoroughly discussed by the court in the reported cases as some other phases of the litiga-tion: ( 1) Under the rule applied by the Court to what extent, if any, must the river the navigable in both directions, up as well as down. ( 2) To what extent, if any, will navigability from one bank to another affect the status of the river? ( 3) In a case not involving interstate commerce what is the definition of commerce in its relation to navigability, and what constitutes useful commerce under the rule laid down in the latest case of the Hold State Bank, 1926? ( 4) In connection with the phrase " customary modes of trade and travel" used by the Court, I should like counsel to stipulate as to the date when power boats came into general |
