My request for special attention to these points must not be taken as an expression of any opinion one way or the other on the questions involved, but simply to call counsel's attention to the fact that there are phases of this case which have not been fully and adequately discussed in the decisions relating to other rivers. I should like to have a copy of all printed reports and books which have been introduced in evidence, so far as such extra copy is available, furnished to me some time during the month of January so that if possible I may at least glance over them to see their nature before the oral argument; I shan't guarantee to read them, but I would like to familiarize myself with the nature of all printed documents and books before I hear argument. ( Discussion off the record.) MR. BLACKMAR: I don't want to close this case on Friday, the 13th, and argue it on April 1st. THE SPECIAL MASTER: Put that in the record, Mr. Garnett, counsel for the government objects to closing the case on Friday the 13th and arguing it on April the 1st. Suppose we say the government files its brief on the 3rd of March; the state the 2nd of April; that will avoid any unfortunate dates; and than why should we not be able to have |
